Bill Summary

AN ACT to amend the real property law, in relation to prohibiting the use of a facial recognition system by a landlord on any residential premises

AI Summary

This bill prohibits landlords from using facial recognition systems in residential properties by defining facial recognition as both an automated process of identifying individuals based on facial characteristics and analyzing facial features to determine a person's sentiment or potential behavior. The bill specifically makes it unlawful for landlords to obtain, retain, access, or use any facial recognition system or information derived from such a system on residential premises. If a violation occurs, the Attorney General can seek a court injunction to stop the practice and may impose a civil penalty of up to $10,000. Additionally, individuals who have been subjected to facial recognition in violation of this law can bring their own legal action to enjoin the violation and recover either actual damages or $1,000, whichever is greater. The bill also stipulates that if a plaintiff prevails in such an action, the court shall award costs and reasonable attorneys' fees. The law will take effect 120 days after it becomes law, providing time for landlords to adjust their practices to comply with the new restrictions.
