Bill Summary

AN ACT to amend the real property law, in relation to prohibiting the use of a facial recognition system by a landlord on any residential premises

AI Summary

This bill prohibits landlords from using facial recognition systems or obtaining information from such systems in residential premises. The legislation defines facial recognition as both an automated process of identifying individuals based on facial characteristics and an analysis of facial features to determine a person's sentiment or potential behavior. The bill makes it unlawful for landlords to obtain, retain, access, or use any facial recognition system or information derived from such systems in residential properties. If a violation occurs, the Attorney General can seek a court injunction to stop the practice and may impose a civil penalty of up to $10,000. Additionally, individuals who have been subjected to facial recognition in violation of this law can bring their own legal action to enjoin the violation and seek damages of either their actual damages or $1,000, whichever is greater. The bill also stipulates that a prevailing plaintiff in such an action will be awarded costs and reasonable attorneys' fees. The law will go into effect 120 days after it becomes law, providing landlords with time to adjust their practices to comply with the new restrictions.
