This bill, known as the "stop deepfakes act," requires providers of systems that create synthetic content (like AI-generated images, videos, or audio) to include "provenance data" on any synthetic content they make available. Provenance data is defined as information about the content's origin, any edits made, and whether a synthetic content creation system was used, all cryptographically bound to the file. This data should not include personal user information unless voluntarily included. The bill also mandates that social media platforms cannot remove this provenance data unless the content is deleted or legally required to be removed. State agencies are also required to apply provenance data to their own electronic publications of audio, images, and videos. The Attorney General is empowered to enforce these provisions through injunctions and civil penalties of up to $25,000 per violation.
