This bill adopts the Uniform Electronic Recordation of Custodial Interrogations Act, which requires law enforcement officers to electronically record (video and audio) entire custodial interrogations related to crimes of violence. The bill establishes several exceptions to the recording requirement, such as exigent circumstances, an individual's refusal to be recorded, safety concerns, equipment malfunctions, or situations where an officer initially did not believe recording was necessary. If an interrogation is not fully recorded, the law enforcement officer must prepare a written report explaining the reason. The bill mandates that the Office of Attorney General develop regulations for electronic recording, including standards for camera angle and recording quality. The legislation also provides that if a recorded interrogation is not fully compliant with the law, a court may consider this when determining the admissibility of statements made during the interrogation. Additionally, the bill includes provisions for self-authentication of recordings and limits civil liability for law enforcement agencies that make good-faith efforts to comply with the regulations. The act will take effect either immediately or by January 1, 2027, depending on when temporary regulations are promulgated.
