This bill establishes comprehensive regulations for kratom retailers, defining kratom products as food or dietary ingredients containing leaves from the Mitragyna speciosa plant. The bill mandates that kratom retailers must label their products with the manufacturer's name, a full ingredient list, and usage directions. Retailers are prohibited from selling kratom products that are adulterated or contaminated with dangerous non-kratom substances, including controlled substances or ingredients that could render the product harmful. The legislation also sets specific restrictions, such as limiting 7-hydroxymitragynine levels to 2% of the alkaloid composition and banning synthetic alkaloids. Additionally, the bill prohibits selling kratom products to individuals under 18 years old. Retailers who violate these provisions face administrative fines, with first-time offenses subject to a $500 fine and subsequent offenses incurring a $1,000 fine. Selling to minors carries escalating fines of $1,000, $2,000, and $5,000 for first, second, and subsequent offenses, respectively. The Department of Public Health is tasked with creating rules and regulations for implementing and enforcing these kratom product standards, with the law taking effect 180 days after its passage.
