This bill establishes regulations for kratom products, which are defined as food products or dietary ingredients containing any part of the Mitragyna speciosa plant or its extracts, intended for human consumption. It requires "kratom retailers" (those who sell, distribute, or advertise kratom products) to ensure that all kratom products are clearly labeled with the manufacturer's information, a full ingredient list, and safe usage directions. Furthermore, retailers are prohibited from selling kratom products that are adulterated or contaminated with dangerous non-kratom substances, including controlled substances, or that contain synthetic kratom alkaloids or a level of 7-hydroxymitragynine exceeding 2% of the total alkaloid composition. The bill also prohibits the sale of kratom products to individuals under 21 years of age. Penalties for violations include administrative fines for labeling and product safety issues, with escalating fines for selling to minors. Retailers can avoid penalties for labeling or safety violations if they can prove they relied in good faith on the manufacturer's representations. The Department of Public Health is tasked with creating rules for enforcement, including labeling and safety testing standards, and the act will take effect 180 days after its passage.
