This bill introduces new legal provisions regarding digital replicas, which are defined as highly realistic computer-generated electronic representations of a person's voice or visual likeness that can be created with or without the person's actual performance. The legislation, to be added to Chapter 214 of the General Laws, establishes that contracts involving digital replicas are only valid for new performances created on or after January 1, 2026, if certain conditions are met: the contract must clearly and conspicuously state the digital replica rights and commercial terms, provide a reasonably specific description of the intended uses, and permit the creation and use of a digital replica in place of in-person work. The bill explicitly excludes traditional uses like sampling, remixing, and digital remastering authorized by copyright holders. Additionally, the legislation does not apply to individuals covered by collective bargaining agreements that already address digital replica usage. This bill aims to provide legal clarity and protection for individuals whose digital likenesses might be used in commercial or professional contexts, ensuring transparency and consent in the creation and use of digital replicas.
