This bill modifies existing Texas education law regarding the sale, lease, or use of unused or underused school district facilities by establishing a structured process for offering such facilities to other educational entities. Specifically, when a school district board of trustees intends to sell, lease, or repurpose an unused facility, they must first provide an opportunity for public school districts, open-enrollment charter schools, and approved private schools to make purchase or lease offers. The bill requires the district to obtain an appraisal of the facility within 12 months of offering it for sale and creates a 90-day period during which only educational institutions can submit offers. During this initial period, the board must accept the best offer that meets or exceeds the appraised facility value. If no qualifying offers are received within 90 days, the district may then offer the facility to the general public. Additionally, if a non-educational entity's offer is selected, the board must give the educational institutions that previously submitted offers 14 days to match or improve upon the selected offer's financial terms. The bill will take effect on September 1, 2025, providing school districts with a clear, structured approach to disposing of underutilized facilities while prioritizing educational institutions.
