This bill establishes a comprehensive process for how independent school districts must handle the sale, lease, or alternative use of unused or underused school facilities. The bill requires school districts to first offer the facility to public school districts, open-enrollment charter schools, and approved private schools before selling or leasing to any other entity. Districts must obtain an appraisal of the facility within 12 months of offering it for sale and must restrict the first 90 days of offers to only those educational entities. During this initial 90-day period, the district must accept the best offer that meets or exceeds the appraised value of the facility. If no qualifying offers are received within 90 days, the district may then offer the facility to the general public. If a non-educational entity's offer is accepted, the original educational entities that made initial offers must be given 14 days to submit a revised offer matching the selected offer's financial terms. The goal of this legislation appears to be providing educational institutions first opportunity to acquire unused school facilities, potentially to expand educational services or repurpose existing infrastructure. The bill will take effect on September 1, 2025.
