This bill establishes the Commission to Study the Apportionment of Service Revenue, a 12-member body comprised of five senators, six representatives, and the State Tax Assessor (or their designee), with balanced representation from the two major political parties. The commission is tasked with investigating how service revenue is currently calculated for corporate income tax purposes in Maine, focusing on four key areas: the current method of apportioning service revenue, the fairness of representing business activities in the state, the potential benefits of "look-through apportionment" (a method of tracing service revenue to its source), and the feasibility of creating safe harbor provisions that would allow corporations to estimate customer locations for tax calculation purposes. By December 3, 2025, the commission must submit a comprehensive report to the Joint Standing Committee on Taxation, which will include findings, recommendations, and proposed legislation. The Legislative Council will provide staff support for the commission when the Legislature is not in session, and the committee may subsequently submit related legislation for consideration during the Second Regular Session of the 132nd Legislature.
