This bill prohibits the sale of playground surfacing materials that contain PFAS (perfluoroalkyl and polyfluoroalkyl substances, a class of fluorinated chemicals), PAHs (polycyclic aromatic hydrocarbons), or more than ninety parts per million of lead, with these restrictions applying to substances intentionally added or present above levels the state environmental department will establish and periodically review. Manufacturers of such materials must provide distributors and retailers with a certificate of compliance, assuring the product meets these standards, and knowingly providing a false certificate is a violation. If the department suspects non-compliance, manufacturers must either provide independent test results or notify sellers that the product is prohibited in the state. Retailers are protected from violations if they relied in good faith on a valid certificate of compliance, and the bill also establishes civil penalties of up to $1,000 per day for violations, with higher penalties for repeat offenses, and allows for injunctions to stop violations.
