Bill Summary
AN ACT to amend the environmental conservation law, in relation to the regulation of toxic substances in playground surfacing materials
AI Summary
This bill prohibits the sale of playground surfacing materials that contain PFAS (perfluoroalkyl and polyfluoroalkyl substances, a class of fluorinated organic chemicals), PAHs (polycyclic aromatic hydrocarbons), or more than ninety parts per million of lead, with these restrictions applying to substances that are intentionally added or present above a level the environmental conservation department will establish and periodically review. Manufacturers of such materials must provide distributors and retailers with a certificate of compliance assuring adherence to these rules, and knowingly providing a false certificate is a violation. If the department suspects non-compliance, manufacturers must either provide independent lab test results or notify sellers that sales are prohibited in the state, and retailers are protected from violations if they relied in good faith on a certificate of compliance. Penalties for violations include civil penalties of up to $1,000 per day for a first offense and up to $2,500 for a second offense, and the bill does not apply to materials sold before its effective date.
