AN ACT to amend the retirement and social security law, in relation to service credit related to the birth or adoption of a new child

This bill provides an opportunity for correction officers in Suffolk County who are members of the New York State and Local Employees' Retirement System (NYSLERS) to receive up to one year of service credit for each period of authorized unpaid leave related to the birth or adoption of a new child. To be eligible, members must have at least five years of credited service, file a claim with the retirement system by December 31, 2026 or within 90 days of leave termination, and contribute to the retirement system an amount they would have contributed during the leave period, based on their most recent twelve months of non-zero compensation. The bill allows members who do not initially have five years of service credit to file a claim within 90 days of achieving that milestone. The service credit is limited to one year per leave period, and in case of any conflicts with other laws, this provision will take precedence. All past service costs associated with implementing this bill will be borne by Suffolk County, and the bill is designed to provide additional flexibility for correction officers in managing family-related leave without negatively impacting their retirement benefits.
