Bill Summary

AN ACT PROHIBITING THE COMMISSION FOR PUBLIC HEALTH FROM ADDING ANY NEW VACCINES TO THE STATE'S CHILDHOOD IMMUNIZATION SCHEDULE UNLESS THE VACCINE HAS EITHER BEEN APPROVED BY THE UNITED STATES FOOD AND DRUG ADMINISTRATION (FDA) FOR A MINIMUM OF THREE YEARS OR, IF FDA-APPROVED FOR LESS THAN THREE YEARS, UPON THE RECOMMENDATION OF BOTH THE NORTH CAROLINA MEDICAL SOCIETY BOARD OF DIRECTORS AND THE NORTH CAROLINA PEDIATRIC SOCIETY BOARD OF DIRECTORS.

AI Summary

This bill modifies North Carolina's childhood immunization requirements by establishing a new three-year FDA approval waiting period for adding new vaccines to the state's childhood immunization schedule. Specifically, the bill requires that any new vaccine added to the schedule must have received FDA approval for a minimum of three years, with an exception allowing earlier addition if both the North Carolina Medical Society Board of Directors and the North Carolina Pediatric Society Board of Directors recommend it. The bill also updates language around parental responsibilities for ensuring child immunizations, expands the Commission for Public Health's rulemaking authority to include setting reasonable fees for vaccine administration and establishing limitations on vaccine requirement conditions. Additionally, the bill maintains existing prohibitions on COVID-19 vaccination requirements for students, allowing such requirements only for specific educational programs involving healthcare facility work or training. The changes are effective immediately upon becoming law and will apply to any new vaccine requirements established for children in North Carolina from that point forward.
