This bill authorizes Frank R. Smith, a retired New York City police detective, to retroactively receive accidental performance of duty disability retirement benefits for illnesses he suffered during undercover assignments. Specifically, Smith, who joined the New York City employees retirement system in 1992 and retired on August 12, 2009, had previously been denied these benefits for diseases contracted during undercover work beginning in August 2002. Under this bill, his retirement benefits would be reclassified from an ordinary disability retirement to an accident disability retirement, which would increase his annual pension from $68,600 to $113,847. The benefits will be paid for and shared equally by all public retirement systems of which Smith was a member. The fiscal note indicates that the total present value of these benefits is estimated at $1.3 million, with the entire increase in employer contributions to be allocated to New York City.
