Bill Summary
AN ACT to amend the retirement and social security law, in relation to the calculation of past service credit for members in the title of deputy sheriff transferring between the New York state and local employees' retirement system to the New York state and local police and fire retirement system
AI Summary
This bill allows deputy sheriffs who previously served as police protection or correction officers and transferred from the New York State and Local Employees' Retirement System (NYSLERS) to the New York State and Local Police and Fire Retirement System (NYSLPFRS) to receive past service credit for that prior service, provided they have at least one year of service and elect to do so within one year of their transfer or the bill's effective date. The calculation of this service credit will involve multiplying their prior service by salary and billing rate multipliers, determined by actuaries, to reflect the difference in salary and billing rates between the two retirement systems, with the total credited service not exceeding their original NYSLERS service or ten years. If a member later transfers back to NYSLERS, their full deputy sheriff service credit will be transferred back, and if they retire under a different plan within NYSLPFRS, they will still receive the full deputy sheriff service credit earned.
