This bill establishes a process for individuals to modify the sex indicator on their birth records in Minnesota. Specifically, the bill allows a person who is 18 years or older, an emancipated minor, or their parent/guardian to request a change, removal, or addition of a sex indicator on their birth record. To make such a request, the individual must submit required forms, pay applicable fees, and provide acceptable documentation, which can include a medical provider's statement, a court order, or a sworn statement affirming the request is made in good faith and not intended to defraud. For minors, the request must also be in the minor's best interest. If the request meets these criteria, the commissioner will grant the change. Individuals can also petition a district court to make the change, and the court will consider the request if it determines the change is made in good faith. Once the birth record is modified, the original record will be classified as confidential and sealed, only to be disclosed through a court order. This bill provides a formal, regulated process for individuals to update their birth records to reflect their gender identity.
