This bill modifies the licensure requirements for fiscal intermediaries (FIs) in the consumer directed personal assistance program, expanding the definition of who can serve as a fiscal intermediary beyond the previously defined statewide fiscal intermediary. The bill now allows three types of entities to serve as fiscal intermediaries: (1) entities with a contract from the Department of Health, (2) service centers for independent living that have been providing fiscal intermediary services as of January 1, 2024, and (3) entities selected by the commissioner as subcontractors as of April 1, 2025. These fiscal intermediaries will have the same status as the statewide fiscal intermediary and are required to provide culturally and linguistically competent services specific to consumer and workforce populations. The bill aims to increase consumer choice by permitting fiscal intermediaries to expand their services into areas lacking choice, with expedited approval from the department. Additionally, the legislation removes previous restrictions on subcontractor selection processes and allows fiscal intermediaries to contract directly with managed care plans, managed long-term care plans, local social services districts, and other long-term service programs to provide fiscal intermediary services to consumers.
