This bill establishes two new federal funds to support border security and immigration enforcement efforts: the State Border Security Reinforcement Fund (administered by the Department of Homeland Security) and the State Criminal Alien Prosecution and Detention Fund (administered by the Department of Justice). The Border Security Fund will provide $11 billion in grants to states, state agencies, and local governments for activities such as constructing border walls or barriers, conducting border surveillance, and relocating undocumented immigrants from small population centers. The Criminal Alien Prosecution Fund will provide $3.5 billion in grants to support activities like locating and apprehending undocumented immigrants, investigating and prosecuting crimes committed by immigrants, detaining immigrants, and supporting law enforcement operations related to immigration enforcement. Both funds will be available from fiscal year 2025 until September 30, 2034, and can retroactively fund activities dating back to January 20, 2021. The funds will automatically terminate on January 20, 2029, with any remaining unobligated funds returned to the Treasury for deficit reduction. Notably, the bill allows states and local governments to receive grants for border security and immigration enforcement activities they have already completed, are currently undertaking, or plan to initiate in the future.
