This bill establishes two new funds to support state and local border security and immigration enforcement efforts. The State Border Security Reinforcement Fund, managed by the Department of Homeland Security, will receive $11 billion in fiscal year 2025 and can be used for border wall construction, border surveillance, ground preparation for border barriers, and relocating undocumented immigrants from small population centers. The State Criminal Alien Prosecution and Detention Fund, managed by the Department of Justice, will receive $3.5 billion in fiscal year 2025 and can be used for locating and apprehending undocumented immigrants, investigating and prosecuting crimes committed by immigrants, supporting court operations related to these prosecutions, detaining immigrants, and providing logistical support to law enforcement agencies. Both funds will provide grants to eligible states, state agencies (including National Guard units), and local governments, and both will be retroactively applicable to activities dating back to January 20, 2021. The funds will be available until September 30, 2034, but will officially terminate on January 20, 2029, with any remaining unobligated funds returning to the Treasury for deficit reduction.
