Bill Summary

AN ACT to amend the public health law, in relation to authorizing certain patients to use medical cannabis at certain health care facilities

AI Summary

This bill amends public health law to allow terminally ill patients to use medical cannabis within hospitals and nursing homes, defining "health care facility" as a general hospital or nursing home, "medical cannabis" as defined in cannabis law, and "patient" as an individual who is terminally ill, also defined by cannabis law. Health care facilities must permit this use but prohibit smoking or vaping, must record its use in patient records, reasonably regulate its storage and use (including requiring locked containers), and develop written guidelines for its use according to cannabis law. This provision does not alter existing laws on cannabis cultivation, possession, distribution, or utilization, nor does it require facilities to recommend medical cannabis.
