This bill amends public health law to allow terminally ill patients, defined as individuals with a life expectancy as specified in cannabis law, to use medical cannabis, which is defined by cannabis law, within general hospitals and nursing homes. Health care facilities must allow this use but prohibit smoking or vaping, must document its use in patient records, reasonably regulate its storage and use (including requiring locked containers), and create written guidelines for its use. This law does not alter existing cannabis laws regarding cultivation, possession, or distribution, nor does it require facilities to recommend medical cannabis.
