This bill provides retroactive Tier II membership in the New York state and local police and fire retirement system (NYSLPFRS) to Daniel Rizzo, who was employed by the Monroe County Sheriff's Office starting on October 19, 2009. Despite initially not being enrolled in the retirement system on his first day of employment through no fault of his own, the bill allows Rizzo to be deemed a member of the system as of his original start date. To take advantage of this, Rizzo must file an application with the retirement system within one year of the bill's effective date. As a result of this retroactive membership, Rizzo will receive a refund of any employee contributions he made that would not have been required had he been granted Tier II status in 2009. The state will bear all past service costs associated with this change, which are estimated at approximately $56,500, and the City of Rochester can expect an increase of about $9,100 in annual contributions for the fiscal year ending March 31, 2026. Currently, Rizzo is a Tier 5 member employed by the City of Rochester, and this bill will retroactively adjust his retirement system status.
