AI Summary
This bill aims to protect minors by regulating intoxicating hemp-derived products under adult use cannabis laws. The bill introduces several key changes, including redefining "hemp" to exclude intoxicating hemp-derived products and creating new definitions for "hemp product" and "intoxicating hemp-derived product." Specifically, an intoxicating hemp-derived product is defined as a hemp-based product containing more than 2 milligrams of total tetrahydrocannabinol (THC) per package or with a cannabidiol to THC ratio less than 25:1. The legislation requires all such products to be transferred to and tracked within the adult use cannabis program, subject to the same regulations, testing, packaging, and labeling requirements as cannabis products. The bill prohibits liquor licensees from selling these products and imposes a 20% tax on wholesale and retail sales of intoxicating hemp-derived products starting January 1, 2026. Additionally, the legislation gives the state's cannabis regulatory office enforcement powers to remove and destroy these products from retail establishments that are not licensed cannabis stores. The primary goal is to ensure these potentially intoxicating products are properly regulated, tested, and kept away from minors, treating them similarly to adult use cannabis products.
