This bill requires certain businesses licensed to sell alcoholic beverages, referred to as "covered licensees," to make drink drug testing devices available to their customers upon request, at no cost, and without being held liable for inaccurate results. These devices must be able to detect at least ten controlled substances and two "date rape drugs" (as defined by federal law), provide results within five minutes, and be manufactured in the United States. Covered licensees must also post a notice informing customers about the availability of these devices and ensure the devices are not expired. Additionally, the bill amends tax law to allow businesses to deduct the cost of providing these testing devices as a business expense when calculating their taxable income.
