This bill requires certain businesses licensed to sell alcoholic beverages, such as bars and restaurants, to provide or make available drink drug testing devices to their customers at no cost. These devices must be able to detect at least ten controlled substances and at least two "date rape drugs" (drugs often used to incapacitate someone for sexual assault), provide results within five minutes, and be manufactured in the United States. The businesses must also post a notice informing customers about the availability of these devices and will not be held liable for any inaccurate test results. Additionally, the bill amends tax law to allow businesses to deduct the cost of these testing devices as a business expense, making it easier for them to comply with the new requirement.
