This bill modifies the procedures for executing search warrants in Michigan, adding several new requirements and protections for law enforcement officers and individuals being served with a warrant. The bill now mandates that law enforcement officers must generally announce their identity and purpose before entering a location, and wait a reasonable period of time before attempting forcible entry. However, the bill also creates exceptions to these requirements in specific circumstances, such as when there is imminent danger to life, evidence suggests the occupants are aware of law enforcement's presence, or announcing entry would inhibit a criminal investigation. When seeking to enter without announcing, officers must include detailed information in their warrant application, such as a list of occupants, their known disabilities, and any animals present. The bill also stipulates that such non-announced entries can only occur between 8 a.m. and 6 p.m. (unless specifically authorized otherwise) and requires that officers be in uniform or clearly identifiable as law enforcement during forcible entry. The term "reasonable period of time" is defined as a duration that allows occupants an opportunity to grant entry while considering the potential for evidence destruction. The bill will take effect 90 days after its enactment into law.
