This bill directs the New York State Department of Health to create an alternative payment methodology (APM) for federally qualified health centers (FQHCs) specifically aimed at preserving and improving patient access to fertility care. The APM will provide additional payments to eligible FQHCs for certain fertility drugs beyond their existing prospective payment system (PPS). For the calendar year 2024, the payment will be calculated as the difference between what an eligible provider would have been paid for specific fertility drugs under Section 340B of the federal Public Health Services Act and the amount that would have been reimbursed by a managed care organization. The specific eligible fertility drugs are limited to gondotropion, GNRH antagonists, and GNRH agonists. This bill is designed to help FQHCs offset potential financial gaps in fertility drug reimbursement and ensure continued access to these important medical treatments. The act is set to take effect immediately upon passage.
