This bill enacts the Share the Health and Empower With Informed Notices (SHE WINS) Act, which establishes extensive new requirements for obtaining informed consent before an elective abortion in Ohio. The bill mandates that at least 24 hours before an abortion, a physician must meet with the pregnant woman in person, by phone, or virtually to provide detailed information about the abortion procedure, including its medical risks, alternatives like adoption and parenting, potential complications, and available medical assistance benefits. The physician must also verbally and in writing inform the woman about child support obligations, her right to withdraw consent, and potential abortion drug reversal. The woman must then sign a form certifying she understands the information, consents voluntarily, and is not under the influence of drugs or alcohol. The bill allows civil lawsuits by "interested parties" (including the woman, her estate, spouse, or parents) against physicians who perform abortions without meeting these consent requirements, with potential damages of at least $100,000, compensatory and punitive damages, and attorney's fees. The legislation also defines various terms like "medical emergency" and "complications" and provides specific guidelines for when an abortion can be performed, with exceptions for medical emergencies.
