Bill Summary

This bill requires a vehicle operator to stop his or her vehicle and remain stopped until a pedestrian crossing at a crosswalk has completed crossing the roadway. Under current law, the operator of a vehicle is required to yield the right-of- way to a pedestrian, personal delivery device, bicyclist, or rider of an electric scooter or electric personal assistive mobility device that is crossing a highway at an intersection or crosswalk controlled by a traffic signal on a green or XwalkY signal or that is crossing a highway at an intersection or crosswalk not controlled by a traffic signal within a marked or unmarked crosswalk. XYield the right-of-way to a pedestrianY is defined to mean that the operator of a vehicle must reduce speed, or stop if necessary, to avoid endangering, colliding with, or interfering with pedestrian travel. The bill requires that, under these circumstances, rather than yield, the vehicle operator must stop the vehicle and remain stopped until the pedestrian, LRB-3408/1 EVM:klm 2025 - 2026 Legislature SENATE BILL 345 personal delivery device, bicyclist, or rider of an electric scooter or electric personal assistive mobility device has completed crossing the roadway.

AI Summary

This bill modifies Wisconsin state law to require vehicle operators to come to a complete stop—rather than simply yielding—when pedestrians, bicyclists, electric scooter riders, personal delivery devices, and other similar users are crossing an intersection or crosswalk, and mandates that drivers remain stopped until these individuals have fully completed crossing the roadway. The bill applies to both signalized and non-signalized intersections, whether the crosswalk is marked or unmarked, and covers various traffic signal scenarios including green signals, green arrow signals, and flashing yellow arrow signals. The legislation changes existing language from "yield the right-of-way" to a more definitive "stop the vehicle," which means drivers must come to a full stop and wait until the crossing is completely finished, enhancing pedestrian safety by creating a more explicit and protective traffic rule. The bill also includes a provision preventing pedestrians and device operators from suddenly leaving a place of safety into the path of an oncoming vehicle that cannot safely stop, ensuring that the new protections apply to responsible behavior from all road users. The changes will first apply to offenses committed on the bill's effective date.
