Bill Summary

This bill requires a vehicle operator to stop his or her vehicle and remain stopped until a pedestrian crossing at a crosswalk has completed crossing the roadway. Under current law, the operator of a vehicle is required to yield the right-of- way to a pedestrian, personal delivery device, bicyclist, or rider of an electric scooter or electric personal assistive mobility device that is crossing a highway at an intersection or crosswalk controlled by a traffic signal on a green or XwalkY signal or that is crossing a highway at an intersection or crosswalk not controlled by a traffic signal within a marked or unmarked crosswalk. XYield the right-of-way to a pedestrianY is defined to mean that the operator of a vehicle must reduce speed, or stop if necessary, to avoid endangering, colliding with, or interfering with pedestrian travel. The bill requires that, under these circumstances, rather than yield, the vehicle operator must stop the vehicle and remain stopped until the pedestrian, personal delivery device, bicyclist, or rider of an electric scooter or electric personal assistive mobility device has completed crossing the roadway.

AI Summary

This bill modifies Wisconsin state law to strengthen pedestrian safety at intersections and crosswalks by changing the requirement for vehicle operators from "yielding right-of-way" to a more definitive "stopping" standard. Specifically, the bill requires drivers to completely stop their vehicles when pedestrians, bicyclists, personal delivery devices, or electric scooter riders are crossing the roadway, and remain stopped until those individuals have fully completed crossing. The changes apply to both intersections controlled by traffic signals and those without signals, covering both marked and unmarked crosswalks. The bill expands this stopping requirement to various traffic signal scenarios, including green signals, green arrows, and flashing yellow arrows, ensuring that vehicle operators must come to a complete halt and wait for pedestrians and other road users to finish crossing before proceeding. This legislation aims to enhance pedestrian safety by creating a more explicit and protective traffic interaction standard, reducing the potential for accidents by requiring drivers to make a complete stop rather than simply yielding. The bill will take effect on its specified effective date and apply to offenses committed from that point forward.
