Bill Summary
Under this bill, if the secretary of administration determines that federal aid to Wisconsin that was previously authorized under an act of Congress is being withheld under an executive order of the president of the United States or in contravention of a court order, the secretary must do all of the following: 1. Determine the approximate amount of federal aid the state is being or is expected to be deprived of as the result of the executive order or contravention of the court order. 2. No later than 60 days after the date of the executive order or court order, submit a report to the governor and the legislature that describes in detail the amount of federal aid the state is being or is expected to be deprived of as the result of the executive order or contravention of the court order and identifies properties located in the state that are owned by the federal government and upon which the state may obtain a lien. 3. Request the attorney general to obtain a lien on one or more of the identified properties in a total amount not to exceed the approximate amount of federal aid the state is being deprived of under the executive order or in contravention of the court order. The bill requires the attorney general to attempt to obtain each such lien. 4. Authorize the release of all liens obtained by the attorney general under the bill upon the state[s receipt of all federal aid previously withheld under the executive order or in contravention of the court order. For further information see the state fiscal estimate, which will be printed as an appendix to this bill.
AI Summary
This bill establishes a legal mechanism for Wisconsin to respond to federal aid being withheld by the president through an executive order or in violation of a court order. Specifically, the secretary of administration must first determine the approximate amount of federal aid being withheld, then submit a detailed report to the governor and legislature within 60 days that identifies specific federal properties in Wisconsin where the state could potentially place a lien. The secretary is then required to request the attorney general to obtain liens on these properties, with the total lien value not exceeding the amount of withheld federal aid. These liens would be automatically released once the state receives the previously withheld federal funds. This approach provides the state with a potential financial recourse mechanism when federal aid is unexpectedly or controversially suspended, allowing Wisconsin to place temporary claims on federal property as a form of leverage or compensation for the lost anticipated funding.
