This bill establishes the "Accountability of Costs for Data Centers Act" (AC/DC Act), which requires electric corporations, gas corporations, and municipalities to create a separate service classification for large energy use facilities, defined as facilities with a peak demand of 20 megawatts or more used for computing infrastructure, data processing, web hosting, streaming support, and related services. The bill mandates that these new service classifications must assign all costs of serving such facilities (including infrastructure upgrades and operational costs) entirely to that classification, ensure that any rate of return is attributed solely to these facilities, and mitigate potential cost increases for other service classifications. The Public Service Commission is required to develop an adjustment mechanism to ensure that any commodity price increases attributable to large energy use facilities are borne by those facilities. Additionally, the department of public service is authorized to develop financial surety requirements, such as insurance, guarantees, surety bonds, or letters of credit, for service providers working with large energy use facilities. The bill requires implementation of these new classifications by June 1, 2030, and takes effect immediately, though new service classifications will not be implemented before June 1, 2027.
