The bill mandates that these new service classifications must comprehensively assign all costs associated with serving large energy use facilities, including infrastructure upgrades and operational expenses, exclusively to that classification, and ensure that such facilities bear the full financial burden of their energy consumption without shifting costs to other service categories. The public service commission is authorized to develop financial surety requirements for these facilities, which may include insurance, guarantees, surety bonds, or letters of credit, and must establish an adjustment mechanism to ensure that any increases in commodity prices attributable to large energy use facilities are borne entirely by those facilities. The bill requires that these new service classifications and mechanisms be fully implemented by June 1, 2030, and prohibits the approval of any rate changes or tariff updates that do not comply with these new requirements, effectively creating a comprehensive framework to manage the economic impact of large-scale data centers on utility services and other ratepayers.
