This bill adds a new section to Michigan's Revised Judicature Act that allows individuals to bring civil lawsuits against those who make false representations in assisted reproduction. The bill specifically enables patients who give birth through assisted reproduction, their spouses, children conceived through such procedures, and donors to sue for damages if they are victims of false representation. Individuals can seek economic and non-economic damages, punitive damages, and attorney fees. The bill defines "false representation" by referencing existing Michigan penal code language and allows plaintiffs to bring an action within 3 years of discovering the false representation.
