Bill Summary

Under current law, the state limits the power of local governments to enact laws on certain issues. This practice is called preemption. This bill repeals the preemptions of local governments from enacting or enforcing ordinances related to the following: 1. Regulations related to wage claims and collections. 2. Regulation of employee hours and overtime, including scheduling of employee work hours or shifts. For further information see the state and local fiscal estimate, which will be printed as an appendix to this bill.

AI Summary

This bill repeals two sections of Wisconsin state law (103.007 and 109.09(3)) that currently limit local governments' ability to create their own employment regulations. By removing these preemption provisions, the bill would allow local municipalities to enact and enforce their own ordinances related to wage claims, collections, employee hours, overtime, and work scheduling. Preemption is a legal principle where a higher level of government (in this case, the state) restricts lower levels of government (local municipalities) from creating regulations on certain topics. The bill effectively gives local governments more autonomy to create labor and employment regulations that might differ from state-level standards, potentially allowing for more localized approaches to workplace rules and compensation.
