This bill establishes new requirements for insurance plans that offer dental coverage and "rent" out their networks of participating dentists to other entities. A "defined network plan," "preferred provider plan," or "limited service health organization" (which are types of health insurance plans) that rents its dental provider network must now include in any new or modified contract with a dentist a notice that they engage in network rental and a list of all entities to whom the network is rented. Additionally, these plans must electronically or in writing notify dentists within 45 days when their contract is being rented to another entity, identifying that entity. Any entity that obtains a dental network through rental must adhere to the original contract's terms, including any discounted rates. Importantly, dentists whose contracts are rented can terminate their participation with the renting entity without breaking their original contract with the insurance plan. This act will apply to contracts and agreements entered into, modified, or renewed on or after its effective date.
