AN ACT to amend 1994 PA 451, entitled ?An act to protect the environment and natural resources of the state; to codify, revise, consolidate, and classify laws relating to the environment and natural resources of the state; to regulate the discharge of certain substances into the environment; to regulate the use of certain lands, waters, and other natural resources of the state; to protect the people?s right to hunt and fish; to prescribe the powers and duties of certain state and local agencies and officials; to provide for certain charges, fees, assessments, and donations; to provide certain appropriations; to prescribe penalties and provide remedies; and to repeal acts and parts of acts,? by amending section 36206 (MCL 324.36206), as amended by 2002 PA 75.
AI Summary
This bill amends existing law to allow local units of government, such as cities or townships, to hold agricultural conservation easements, which are legal agreements that restrict development on farmland to preserve it for agricultural use. Previously, these easements were primarily held by the state. The bill clarifies that while the state can delegate enforcement of these easements to local governments, the state retains a third-party right of enforcement, meaning it can step in if the local government fails to uphold the easement's terms. It also allows for the transfer of these easements under certain conditions and notes that existing tax credits for landowners with agricultural conservation easements remain in place. This change is part of a larger package of bills related to land use and agricultural preservation.
