This bill establishes regulations for the use of artificial intelligence (AI) in psychological and counseling services in Florida. The bill defines AI as a machine-based system that can autonomously generate outputs, decisions, or recommendations based on input. It prohibits licensed psychologists, clinical social workers, marriage and family therapists, and mental health counselors from using AI directly in their professional practice. However, the bill allows limited AI use for administrative and supportive functions, such as scheduling appointments, processing billing, managing patient records, and transcribing therapy sessions, provided that written informed consent is obtained at least 24 hours before using AI for session recording. The key restrictions are designed to prevent AI from directly providing therapeutic advice or replacing human professional judgment in mental health services. The provisions will apply to various mental health professionals and their associated licensees, registered interns, and certificateholders, with the regulations set to take effect on July 1, 2026.
