Bill Summary

This bill requires the governing body of each public school to verify the employment eligibility of teaching staff members and school employees. Under the bill, beginning with teaching staff members and school employees hired for the first full school year next following the date of enactment of the bill, the governing body of each public school is required to, upon hiring a teaching staff member or school employee, verify the employment eligibility of the teaching staff member or school employee through the E-Verify program. E-Verify is an electronic verification of work authorization program jointly operated by the United States Department of Homeland Security and the Social Security Administration. The governing body of each public school is also required to annually verify the employment eligibility of all teaching staff members and school employees through the E-Verify program. The bill directs the Commissioner of Education to provide information regarding the requirements of the bill and the requirements of federal law governing the use of the E-Verify program to the governing body of each public school. The bill requires the commissioner make the information available on the Department of Education's Internet website. The bill stipulates that the provisions of the bill are not to be construed to prohibit the governing body of a public school from hiring a teaching staff member who holds a valid limited certificate for noncitizen teachers issued by the State Board of Examiners pursuant to current State law.
