This bill requires that workers on certain data center construction projects be paid the prevailing wage, which is the standard wage rate for a particular craft or trade in a given area, as determined by the Commissioner of Labor and Workforce Development. A "data center construction project" is defined as work on a facility primarily used for servers and related equipment for data processing, storage, and distribution, if it has an electrical capacity of 250 kilowatts or greater, or is designed to use five megawatts or more annually. Contractors undertaking these projects must be registered with the state, have a good safety record, provide proof of insurance and performance bonds, and ensure workers have specific safety training, including OSHA-10 for all workers and OSHA-30 for supervisors, and undergo drug testing. The bill also allows for project labor agreements, which are pre-hire collective bargaining agreements between labor and management, for larger projects (25 megawatts or greater annual usage) if it's determined to benefit the community by promoting energy efficiency, quality, safety, timeliness, and a skilled workforce. These provisions apply to projects starting after the bill becomes law.
