This bill requires that workers on certain data center construction projects be paid the prevailing wage, which is the standard wage rate for a particular craft or trade as determined by the Commissioner of Labor and Workforce Development. A "data center construction project" is defined as construction for facilities primarily used for processing, storing, and distributing electronic data, with specific thresholds for electrical capacity or annual usage of five megawatts or greater. Contractors undertaking these projects must be registered with the state, have a good safety record, provide proof of insurance and performance bonds, and be jointly liable for any unpaid wages by subcontractors. Additionally, workers must complete general construction training (OSHA-10), supervisors must have advanced training (OSHA-30), and all workers must undergo drug testing. The bill also allows for project labor agreements on larger projects (25 megawatts or greater) if it's determined that the project benefits the community by promoting energy efficiency, quality, safety, timeliness, and a skilled workforce.
