This bill amends the Criminalization of Non-Consensual Pornography Act to create new criminal offenses related to the distribution of digitally manipulated sexual imagery, known as "false sexual images". The bill defines such images as sexually explicit content created or altered through digital technology that a reasonable person would believe depicts a real person's speech or conduct. It establishes two levels of criminal offense: a misdemeanor (second-degree) and a felony (first-degree). The misdemeanor applies when someone knowingly distributes a false sexual image without the depicted person's consent, with intent to harass, sexually arouse, or gain financial benefit. The felony charge applies in more serious circumstances, such as repeat offenses, intent to cause bodily harm, or when the victim is a minor and the perpetrator is in a position of trust or significantly older. Penalties range from up to 180 days in jail and fines for the misdemeanor to up to 2 years in prison and fines for the felony. The bill includes an exemption for licensed communications providers and will take effect after mayoral approval and a 60-day congressional review period.
