AI Summary
This bill makes several changes to laws governing community associations, including homeowners' associations (HOAs) and condominium associations. Key provisions include deeming the governing documents of dissolved HOAs as terminated and unenforceable, requiring county clerks to note this termination in public records, and allowing exclusive easements held by dissolved HOAs to revert to the property owner if taxes have been paid, preventing them from becoming public rights-of-way unless specifically recorded for public use. The bill also defines "habitable" space in buildings, revises the definition of "video conference" to include requirements for remote attendance and recording, and mandates that condominium and HOA governing documents include a statement about being governed by state law or be amended to include it. Developers are now required to complete a turnover inspection report before transferring control of a condominium property to unit owners. The bill removes the requirement for presuit mediation for certain disputes, allowing parties to proceed directly to arbitration or court, and revises rules for electronic ballot transmission. It also introduces new provisions for the termination of HOAs, establishing a process for a "plan of termination" that must be approved by members and reviewed by a new "community association court program," which circuit courts are authorized to create and administer to handle disputes related to condominiums, cooperatives, and HOAs. Furthermore, the bill clarifies that directors, officers, and committee members of HOAs owe a duty of loyalty and must disclose conflicts of interest, with transactions involving conflicts being voidable. It also prohibits associations from restricting the type of material used for building or rebuilding roofs under certain conditions. Finally, the bill makes conforming amendments to various statutes and specifies an effective date of July 1, 2026.
