AI Summary

This bill aims to enhance the safety of dialysate and dialysis products in South Carolina by establishing stricter regulations, particularly concerning products manufactured in China and those containing aluminum. It amends existing law to declare that dialysate or dialysis products made in China are automatically considered defective and unreasonably dangerous, making sellers liable for harm caused by such products. Furthermore, the bill makes it unlawful for healthcare providers to substitute a patient's prescribed dialysate or dialysis product with one manufactured in China or containing aluminum, specifically for patients under twenty-one years old. The bill also prohibits the knowing use, sale, prescription, or distribution of any dialysate or dialysis product originating from China or containing aluminum to patients under twenty-one, classifying violations as misdemeanors punishable by fines or imprisonment. The Department of Public Health is tasked with creating regulations to enforce these provisions.
