This bill amends Florida state law to create a new special licensing system for THC-infused beverages, which are defined as any consumable drink containing hemp-derived delta-9-tetrahydrocannabinol (THC) or other intoxicating cannabinoids. The bill requires that only businesses with a specific quota license or a new special license issued by the Division of Alcoholic Beverages and Tobacco can legally sell these beverages at retail. Any individual or entity selling THC-infused beverages without the appropriate license will be prohibited from doing so and will face penalties equivalent to those for unlicensed sale of alcoholic beverages, as outlined in chapters 561, 562, and 565 of Florida statutes. The special license will be available for restaurants and similar establishments that are authorized to sell intoxicating beverages by the drink for on-premises consumption. The new licensing requirements and regulations will take effect on July 1, 2026, providing time for businesses and regulatory agencies to prepare for the implementation of this new framework.
