This bill defines "THC-infused beverage" as any drink intended for consumption that contains any intoxicating hemp-derived cannabinoid, such as Delta-8, Delta-9, Delta-10, hexahydrocannabinol, tetrahydrocannabinol-O, or tetrahydrocannabinol-P, regardless of whether it also contains alcohol. It then authorizes individuals or entities holding an active alcoholic beverage license to sell, offer for sale, or distribute these THC-infused beverages at retail in Florida. Crucially, any person or entity without such a license is prohibited from selling, possessing for sale, or distributing these beverages. Violating these provisions will be treated as engaging in unlicensed activity under the Beverage Law, carrying the same penalties as the unlicensed sale of alcoholic beverages, and the act is set to take effect on July 1, 2026.
