Bill Summary
As introduced, creates a cause of action through which a victim can recover from a person, other than a professional bondsman or person with a bailable interest, who posts bail for a defendant and the defendant is subsequently convicted for a criminal offense that occurred while the defendant was on bail; allows the victim to recover for damage to property, injury, or death arising from the subsequent criminal offense. - Amends TCA Title 40.
AI Summary
This bill allows victims of crimes committed by a defendant who was released on bail to sue the person who posted that bail, provided that person is not a professional bondsman or someone with a close relationship to the defendant (like a spouse, parent, child, sibling, legal guardian, or employer). If a defendant commits a new crime while out on bail, and the bail was posted by someone outside of these protected categories, the victim of the new crime can seek compensation for any property damage, injury, or death caused by that subsequent offense. This new legal avenue for victims will be available for crimes occurring on or after July 1, 2026.
