This bill modifies Indiana law to allow the commissioner of the Indiana Department of Transportation (INDOT) to award road construction, improvement, or maintenance contracts to a bidder other than the lowest bidder under specific conditions. The new provisions permit the commissioner to select a non-lowest bidder if the alternative bidder is responsive and qualified, commits to employing at least 65% Indiana residents (defined as individuals with a primary Indiana residence for 12 consecutive months prior to the project), and meets certain additional criteria. The alternative bid must be no more than 5% higher than the lowest bid and within the project's estimated cost. The commissioner must also determine that awarding the contract to this bidder serves the best interests of the project and community. Furthermore, the bidder must demonstrate participation in a registered apprenticeship program, use the E-Verify system to verify worker eligibility, maintain a policy against independent contractors, and submit certified payroll reports. This bill aims to provide more flexibility in contract selection while prioritizing local employment and workforce standards for road infrastructure projects.
