This bill modifies Florida Statutes regarding private schools, specifically for those enrolling 150 students or fewer. It establishes that such private schools are considered a permitted use in most zoning districts, meaning they don't need special zoning approvals or to meet extra conditions to operate, except in residential zones. These schools will also be subject to the same building code occupancy requirements as certain other types of facilities (Class A-1, A-3, B, or M) and won't face additional state or local health and safety regulations beyond those. For existing facilities, fire officials are directed to use specific, less costly evaluation systems from NFPA 101A as alternatives for fire safety. Furthermore, private schools of this size moving into or operating within existing assembly, day care, mercantile, or business occupancies must meet certain fire code requirements for sprinkler, detection, alarm, and communication systems, with specific exceptions for sprinkler systems in educational areas based on size and location, and a general requirement for sprinklers in educational occupancies below the exit discharge level unless specific exit conditions are met. This act is set to take effect on July 1, 2026.
